Age CC Guidelines to be Phased Out

President Bush this summer signed into law House Bill 4040, the Consumer Product Safety Improvement Act of 2008, which mandates some important requirements for ATV manufacturers.

The Consumer Product Safety Commission on November 14 published the new requirements in the Federal Register as a mandatory consumer product standard. The standard takes effect 150 days after it was published.

What does this mean for ATV riders?

The new law sets safety and equipment standards that all new ATVs manufactured in the United States, or imported for sale in the United States, must meet.

We believe purchasers will have more youth model ATVs to choose from, since we have already seen the introduction of new 2009 youth models.

Also, under the new law, manufacturers and distributors will have to submit action plans to the CPSC. These action plans will include how safety training will be provided to purchasers and how other safety related materials will be distributed.

The new standards do away with the unrealistic age/cc guidelines that have been in place for years. Now, new youth ATVs will be designated for specific ages of riders based on the maximum unrestricted speed of the machine.

There will be four categories:

1. Youth (6+) 15 mph,
2. Youth (10+) 30 mph,
3. Youth (12+) 30 mph, and
4. Transitional (14+) 38 mph.

This new law will make it easier for dealers and families alike when it comes to selecting a new ATV for junior. Simply read the label on the machine. Forget about the engine size.

If the label says "for 10+" all you and the dealer need to know is the age of your child.

Prior to this law, anyone could build an ATV and it didn't have to meet any basic safety standards. In recent years this created a flood of inexpensive foreign imports.

Meanwhile, most of the long-standing ATV manufacturers agreed in 1988 to a set of safety standards and offered hands-on FREE rider training that the recent imports did not.

With the new law, this has all changed.

How will this effect states that currently have laws on the books that say your 13-year-old child can only ride 90cc machines is unclear.

We are looking into this, and other issues, and will keep you posted.

so wat if ur 8 yr old is the size of a 14 yr old and is mature enuf to ride a bigger one?

if i read it correctly when it was CC's a child up to 16 could only ride up to a 90cc and now it will be that the atv has to have a governor to hold speed at a certain speed per riders age , he or she will be able to ride a larger atv but at slower speeds ,this is what the dealers have to sell the customer if they come in a ATV Dealership to purchase one for thier child .way around it leave child at home buy it for your self then let he or she ride it .i would think if the ATV manufactures put a governor on the atvs in the future they will be ajustable as the child ages . now this is just a guess but thats what it sounds like its leading too

No that means kids can ride bigger one they just will have to have a governor on them form the factory. for say like 125cc and less.

i know this may sound like i am bein a brat, but i think the government should not get a say in what size four wheeler and how fast it goes for my kid. I of all people am very aware of consequences of not bein safe while riding a 4 wheeler but some 10 yr olds are more mature than some 14 yr olds and vice versa. Why dont they just put a govener on it and let the parents make the decision for there child on how fast/slow to allow them to go.

i know! they have a throttle stop screw so you can adjust how for they push the gas that is enough lol.....

I believe this is a good idea, as we do need some kind of limit. Now while I was riding a 250 when I was 6, I still have to tell people no sometimes ( I work for the local Yammy dealer). I don't like doing it, but we can get in severe trouble over it if we get "shopped". I can understand people getting pissed over it, but they should also understand that if I know the childs age that is going to be riding it and they are not the proper age for the atv, I can not sell it to them. It is not my fault and I aint going to get in trouble over it.
